Євромайдан SOS: список зниклих та затриманих Росією активістів та кампанія спільних дій на їхній захист

Євромайдан SOS звертає увагу на переслідування представників місцевого самоврядування, журналістів, релігійних діячів, волонтерів та громадських активістів, які відбувається на тимчасово окупованих після вторгнення Росії у лютому 2022 року українських територіях.
Ми отримуємо звернення від постраждалих представників громадянського суспільства та їхніх рідних, які стали жертвами погроз, фізичного насильства, насильницьких зникнень, свавільних затримань та інших форм переслідування на території Мелітополя, Херсону, Бердянську, Каховки, Славутича та інших населених пунктів.
У 2014 році Росія вже проводила таку умисну політику з метою швидкого отримання контролю над українськими територіями - Кримом та частиною Донбасу. Тоді проросійські незаконні збройні формування фізично знищували чи видавлювали за межі регіону активних людей, які у мирний спосіб могли чинити опір окупації. Викрадення активістів вселило в окупантів відчуття безкарності за воєнні злочини та злочини проти людяності, які вони продовжують вчиняти відносно громадян України.
Сьогодні Росія повторює цю політику свідомо, бо не може втримати окуповані нею міста через активний спротив місцевого населення.
З огляду на зростаючу кількість випадків захоплення заручників, ці дії слід розглядати як заборонений метод ведення війни. Це підтверджується спеціальною метою таких дій, що спрямовані на примушування представників громадянського суспільства до співпраці із представниками країни-агресора чи недобровільного припинення публічної діяльності правозахисників, журналістів та інших захищених осіб відповідно до норм міжнародного гуманітарного права.
Євромайдан SOS нагадує, що в умовах міжнародного збройного конфлікту категорично заборонено затримання цивільних осіб відповідно до статті 34 (IV) Женевської конвенції про захист цивільного населення під час війни від 12.08.1949 року, статті 75 Додаткового протоколу до Женевських конвенцій від 12.08.1949 року, що стосується захисту жертв міжнародних збройних конфліктів (Протокол 1) від 08.06.1977 року.
До всього звільнені представники громадянського суспільства розказують про застосовані щодо них погрози, незаконне фізичне насильство та неналежні умови утримання, що порушує гарантії поводження із цивільними особами та утворюють склад воєнних злочинів.
У зв’язку із вищевикладеним Євромайдан SOS закликає:
1. Представників громадянського суспільства України та інших країн долучитися до кампанії на захист людей, що лишилися сам-на-сам з окупантом, і для цього заповнити ось цю форму: https://forms.gle/enr5822SvPrJZC6Y7

3. БДІПЛ ОБСЄ, Постійну раду ОБСЄ у Відні, Комісара Ради Європи з прав людини, моніторингових та конвенційних механізмів Ради Європи, географічних та тематичних мандатів ООН, Ради ООН з прав людини, Верховного комісара ООН за прав людини, Офісу ООН з координації гуманітарних справ (UN OCHA), Міжнародного комітету Червоного Хреста забезпечити міжнародну присутність на тимчасово окупованих після вторгнення Росії у лютому 2022 року українських територіях та вчиняти активні дії для захисту представників громадянського суспільства від переслідувань.
4. Уряди іноземних держав співпрацювати з урядом України у питанні переслідування осіб, причетних до насильницьких зникнень та інших міжнародних злочинах на окупованих територіях .

Euromaidan SOS: the List of the Activists Missing or Detained by Russia and Proposals regarding a Joint Action Campaign Aiming to Protect Them

Euromaidan SOS draws attention to the persecution of local government officials, journalists, religious leaders, volunteers, and civil society activists on the territories of Ukraine temporarily occupied by the Russian Federation following its invasion in February 2022.
We receive appeals from civil society activists and their relatives who have suffered from threats, physical violence, enforced disappearances, arbitrary detentions, and other forms of persecution in Melitopol, Kherson, Berdyansk, Kakhovka, Slavutych, and other cities and settlements.
In 2014, Russia already pursued a deliberate policy of a kind in order to quickly gain control over Ukrainian territories - Crimea and a part of Donbas. At the time, pro-Russian illegal armed groups were either physically eliminating people with active stand who could peacefully resist the occupation or evicting them from the region. The abductions of civic activists gave occupants a sense of impunity for war crimes and crimes against humanity that they continue committing against the citizens of Ukraine.
Today, Russia applies the same policy deliberately, as it cannot hold occupied cities due to the active resistance of the local population.
Given the growing number of hostage-taking cases, these actions should be considered a prohibited method of warfare. The correctness of such an approach is confirmed by the specific purpose of these actions, namely, to force civil society activists to cooperate with the representatives of the aggressor country or to terminate public activities of human rights defenders, journalists, and other persons protected by the international humanitarian law.
Euromaidan SOS reminds us that in the context of an international armed conflict, the detention of civilians is strictly prohibited under Article 34 of the (IV) Geneva Convention relative to the Protection of Civilian Persons in Time of War as of 12 August 1949 and Article 75 of the Additional Protocol to the Geneva Conventions as of 12 August 1949 relating to the Protection of Victims of International Armed Conflicts (Protocol 1) as of 8 June 1977.
In addition, the rescued civil society activists report on the threats, illegal physical violence, and inadequate conditions of detention, which violate the guarantees of treatment of civilians and are to be considered a war crime.
In connection with the above, Euromaidan SOS urges:

3. ODIHR OSCE, the OSCE Permanent Council, Council of Europe Commissioner for Human Rights, monitoring and convention mechanisms of the Council of Europe, geographical and thematic mandates of the United Nations, UN Human Rights Council, UN High Commissioner for Human Rights, United Nations Office for the Coordination of Humanitarian Affairs (UN OCHA), International Committee of the Red Cross to ensure an international presence in Ukrainian territories, temporarily occupied after the Russian invasion in February 2022, and to take active actions to protect civil society activists from persecution.
4. Governments of foreign states to cooperate with the Government of Ukraine in the prosecution of persons complicit in enforced disappearances and other international crimes in the occupied territories.
